Terms of Service

1. Agreement to Terms

By accessing or using the Scaling Systems platform at scalingsystems.ca (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Scaling Systems provides a multi-tenant SaaS platform offering managed website hosting, communication services (SMS, voice, email campaigns), and related tools for businesses. Services are provided on a subscription basis as described in our service catalog.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscriptions and Billing

Paid services are billed in advance on a recurring basis. You authorize us to charge your payment method for all fees associated with your subscription. Prices may change with 30 days' notice. Refunds are handled on a case-by-case basis at our discretion.

5. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) send unsolicited or unauthorized communications (spam); (c) transmit malware, viruses, or harmful code; (d) infringe on the intellectual property rights of others; (e) harass, abuse, or harm another person; or (f) interfere with or disrupt the Service.

6. Intellectual Property

The Service, its original content, features, and functionality are owned by Scaling Systems and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you upload to the platform.

7. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may cancel your subscription at any time through your dashboard or by contacting support.

8. Limitation of Liability

To the maximum extent permitted by law, Scaling Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance.
